Terms of Service

Last updated: October 5, 2026

The short version: pay month to month, cancel anytime, check what the assistant tells your customers, and don't use it for medical or other sensitive matters.

1. Agreement

These terms are between you (the business signing up) and Bytler, operated by Michael Kmbikyan in Glendale, California ("we," "us"). By signing up for or using Bytler, you agree to these terms and to our Privacy Policy. You confirm you are at least 18 and have the authority to bind your business.

2. The service

Bytler is an AI chat assistant that we set up for your website, trained on your business information. We work to keep it available around the clock but can't promise it will never be interrupted. Your plan includes up to 1,500 visitor messages per month. If that limit is reached, the assistant tells visitors to contact you directly until the next month.

3. Your responsibilities

4. AI limitations

The assistant uses artificial intelligence and can be wrong or misunderstand a question. It is not a substitute for your staff or for professional advice, and it can't make binding promises on your behalf. You remain responsible for prices, bookings, availability, and anything important to your customers. Tell us right away if the assistant says something wrong and we'll correct it.

5. No medical or sensitive information

Bytler is not designed for health information, and we are not a HIPAA business associate. Do not use it to collect, discuss, or store medical details, payment card numbers, passwords, or government ID numbers. If you operate a health-related business, set your assistant to direct those conversations to your staff.

6. Fees and billing

7. Your content and ours

You keep ownership of your business information and content. You give us permission to use it to provide Bytler to you. We own the Bytler service, software, and brand. We will only name you as a customer, or show your assistant publicly, with your written permission.

8. Suspension and ending the service

Either of us can end the service at any time. We may pause or end your service for non-payment or for use that breaks these terms or the law. After the service ends, we delete your data as described in the Privacy Policy.

9. Disclaimer

Bytler is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties about accuracy, uptime, or fitness for a particular purpose.

10. Limit of liability

To the fullest extent the law allows, we are not liable for indirect or consequential damages, including lost profits or lost customers, and our total liability for any claim is limited to the fees you paid us in the three months before the claim arose. Nothing here limits liability that the law doesn't allow to be limited.

11. Your indemnity

You agree to cover claims brought against us because of the content you give us, your instructions to the assistant, or your breach of these terms.

12. Changes to these terms

We may update these terms. For significant changes we'll email you in advance, and continuing to use Bytler after the change means you accept it.

13. Governing law

These terms are governed by California law, and disputes will be handled in the state or federal courts located in Los Angeles County, California.
